Our pledge regarding non-public personal information is reflected in this Privacy Policy and ensured with physical, electronic and procedural safeguards. We value your trust and respect the fact that you may wish to keep voluntary information confidential.

The following is our policy concerning how we handle your information:

  1. Collection of your information

    We collect non-public personal financial information about you from the following sources:

    1. Information furnished by you.  This is information you give us on applications and other forms, by phone, through your broker or online (if applicable). This information includes names of employees, addresses, telephone numbers, health information such as medical records or illness, disability information, driver's license numbers, Social Security or Federal Tax Identification numbers, dates of birth, occupation and responsibilities, length of employment, gender, marital status, policy or claim information, financial statements, and a report of credit history.

    2. Information about transactions.  This is information about your trusted transactions with our affiliates and us. It includes your insurance, coverage premiums, contributions and selection, your payment and claims history and information necessary for billing and payment. Other information used to investigate and settle insurance claims, such as witness statements and police reports, may be included as well.

    3. Information we receive from third parties.  Information received from credit reporting agencies will generally be used to confirm or supplement application information. We disclose consumer report information only as necessary to quote, approve or service your insurance coverages and as permitted by law. By obtaining a quote, you consent to our sharing of this information with companies and their affiliates for underwriting, actuarial and claims purposes. We also receive information from trade associations relating to the self-insured trusts with which we are appointed as program managers. This information is used for documentation and marketing purposes.

     

  2. Disclosure Policy

    Program Risk Management does not disclose any non-public personal information about our customers or former customers to affiliated or non-affiliated third parties for marketing purposes.

    Except as permitted or required by law, advance notice will be given and written authorization secured from you should we intend to share privileged information with unaffiliated third parties. We share information only required to service customers and administer our business. Parties to whom the information may be disclosed include:

    1. Your agent or broker;

    2. reinsurers and other parties supporting the insurance process;

    3. parties involved in claims processing (adjusters, appraisers, investigators, medical examiners);

    4. regulatory agencies and law enforcement;

    5. persons authorized by subpoena, warrant or other court order;

    6. entities having a legal interest (lienholder, mortgagee, assignee);

    7. parties acting in a fiduciary or representative capacity to you;

    8. parties enforcing Program Risk Management's rights in connection with settlement of a debt, transfer of interest or collection efforts;

    9. parties administering transactions as requested or authorized by you.

  4. Confidentiality and Security

    Program Risk Management restricts employee access to your personal information. Only those employees who have a legitimate business need to provide products or services to you are permitted disclosure. All employees are expected to preserve confidentiality and are prohibited from making unauthorized disclosure of personal information obtained about customers or claimants. Violation of this policy may subject the employee to disciplinary action.

    Security measures are taken to guard against unauthorized access of personal information. These include, but are not limited to, locked files, user authentication, firewalls, encryption, and detection software. We educate our employees to responsibly identify sensitive information and implement adequate levels of protection for that data, limiting access as permitted or required by law.

  6. Online Privacy Policy

    Visitors are not required to provide any personal information in order to access our website (http://www.prm.com) and browse anonymously. We do not resell or transfer email addresses or any other personal information to unaffiliated third parties for marketing purposes. We do not sponsor or have a relationship with any ad server company.

    We may use cookies to track usage, facilitate site navigation, and measure traffic without duplicate counting of repeat users. We do not use cookies to collect information for distribution to third parties or secure information from other websites you may visit. Furthermore, we do not link cookies to identifiable information.

    Encoding of data using Secure Sockets Layer (SSL) encryption technology ensures safe transmittal of data and protection against loss, misuse or alteration of collected information.

    Program Risk Management is not responsible for the privacy practices or the content of any other websites that are hyperlinked to or from our website. Furthermore, we shall not be responsible for any illegal interception or use of data by third parties when transmitted to or from our web server.

  8. Customer Rights

    You have a right to know what retrievable information we retain about you and have access to that information. A copy will be furnished upon receipt of a written request from you on your letterhead. We reserve the right to implement a reasonable fee to process future requests. Please include your name, title, and certificate or policy number. Upon review, you have a right to notify us of any discrepancy that should be corrected, amended or deleted. We will provide a written reply detailing our position and necessary course of action if determined to be appropriate or required. We do not control information given to us by third parties. Therefore, you will need to contact the third party directly to address any discrepancies you identify.

    If coverage is declined or the charge for coverage is increased because of information secured in a credit report we ordered, we will tell you as required by state law and the federal Fair Credit Reporting Act. We will also give you the name and address of the consumer reporting agency making the report.

    Program Risk Management supports these rights and we will continue to follow this policy regarding non-public information even when a customer relationship no longer exists. We  will continually review our privacy policy  and notify you prior to introducing any changes. We endeavor to use vendors whose approach to customer privacy reflects our own. Finally, we will make every reasonable effort to assist you in exercising your rights and will not attempt to dissuade you from doing so.

  10. Dispute Resolution

    Any controversy or claim arising out of or relating to our Privacy Policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.

  12. Reservation of the Right to Disclose Information in Unforeseen Circumstances

    In connection with the potential sale or transfer of its interests, Program Risk Management reserves the right to sell or transfer your information (including, but not limited to, your name, address, age, gender, ZIP code, state and country of residency and other information that you provide through other communications) to a third party entity that:

    1. Concentrates its business in a similar practice or service;
    2. agrees to be Program Risk Management's successor in interest with regard to the maintenance and protection of the information collected; and
    3. agrees to the obligations of this Privacy Policy.
